==================================================================================== TF (TIME FOR) STOCK PHOTO SUPPLY/USAGE AGREEMENT ==================================================================================== PURPOSE OF AGREEMENT The purpose of this document is two-fold: 1. It offers the photoshoot model an assurance from the photographer of what he or she will receive in terms of photographic compensation and; 2. It is meant to define the permitted usage of the Rights-Managed (RM) photos produced during TF-type Royalty-Free (RF) stock photo shoot so as to avoid an RM and RF photo usage conflict. In this specific case this document outlines an agreement between Mike Cherim "photographer" and ________________________ "model" and is being entered on _____________ for photos produced during the ____________________________ photoshoot. PHOTOGRAPHER'S SUPPLY OBLIGATION All supplied photos will come from what is left after an extensive culling or deletion of inferior photos. The photographer is very particular wanting to provide the model with only high quality photos. This culling takes places at different points throughout the extensive, labor-intensive processing routine (*.NEF (RAW) > *.tiff > *.jpg). Generally, photos that are not suitable for stock purposes will still be processed for the model if the photo has a great composition. The photographer will supply one to two types of photos from the shoot. First is low resolution (low-res) watermarked version roughly 800x531(D) pixels, these are great for online usage and this is guaranteed. A larger high resolution (high-res) version at least 1701x1130(D) pixels and up to 4288x2848 is also usually supplied - this size is not generally watermarked and it may differ from the smaller version, meaning it may lack some of the more extensive photo manipulations that the photographer can get away with on the smaller version but not so on the larger version without unacceptable levels of photo quality degradation. This is really in the model's as well as the photographer's best interest. The larger size, if provided, is specifically for making prints and should be retained for said purpose. It is this larger size that has the most real "value." These photos can be delivered in a variety of ways. The photographer's preference is to put them in a folder on a server online and simply provide the web address to the model. This is easy for both parties generally. If not, there are options such as mailing a disc, emailing them in small batches, etc. The model should specify if something is else wanted. Actual prints are not supplied. RAW format and unprocessed photos will not be supplied. What will be supplied are JPEGs (*.jpg). These will be fully processed, finished photos. The level of processing will depend on the photo and the model's wishes. Some models prefer a more unretouched look, while others prefer a smoother, more retouched look. The photographer will try to meet the needs of the model. Processing time can take up to one month but delivery is usually done within a week or two. The photographer will try his best, and will deliver in batches if processed accordingly. In other words the model can get a few new photos added to their folder daily. The level of processing even on "unretouched" photos, can be fairly extensive. The end-result, by design, is as much photo perfection as possible. This benefits both parties. MODEL'S RM PHOTO USAGE RESTRICTIONS Supplied photos are for personal use only. This means specifically that the model may post the smaller low-res watermarked version online on sites such as ModelMayhem, Flickr, Facebook, MySpace, etc. These photos cannot be sold, distributed, used in designs, or posted on sites where such activities take place. Moreover they may not be given away to anyone who would use them in such a way that violate this agreement. Granted it's impossible to control the saving and usage of photos posted on such sites, but certain precautions should be taken by the model to protect the photographer's copyright, specifically: 1) The photo has an embedded copyright in its EXIF data that must be not be removed. 2) The visible watermark on the smaller version must not be removed or cropped out. 3) The photo should be credited, linked, and copyright marked where ever applicable. The model may print the larger high-res version on a printer or via a commercial service, but is not permitted to post the them online. Period. The printed photos, like the low-res version, cannot be sold, distributed, or used in designs. Moreover they may not be given away to anyone who would use them in such a way that violate this agreement. They can be framed and hung on the wall, or placed in a physical portfolio book, even given to family or friends during the holidays.
